Fannie Mae 26-08 Makes Special Financing Checklists an Intake Item
Fannie Mae's August 2026 loan-document update gives tax abatement and third-party financing materials a clear place on the closing calendar.
Fannie Mae's Lender Letters page lists Lender Letter 26-08, dated August 25, 2026, as a loan-document update that may be used immediately and must be used for most mortgage loans with a confirmed Commitment Date on or after September 22, 2026. The same timing applies to forward conversions occurring on or after September 22, 2026, when consistent with the Forward Commitment Letter.
The letter publishes Form 6432 as a Tax Abatement Analysis Checklist and Form 6436 as a Third-Party Financing Checklist. Fannie Mae describes the tax abatement checklist as covering general information, lender and underwriting review, legal tax abatement analysis, narrative analysis, and not-in-place or springing tax abatements. The third-party financing checklist addresses categories including soft financing, hard financing, LIHTC equity bridge loans, grant funding, tax-exempt financing, and other equity bridge loans.
For borrower-side closing counsel, the practical move is to ask about these items at intake. A first request list should identify the confirmed commitment date, forward conversion status, any tax abatement or PILOT structure, subordinate or public financing, grant funds, tax-exempt financing, LIHTC bridge components, and the documents the lender will expect to support those facts.
The closing risk is not only that a form is missing. It is that a special financing or tax abatement issue becomes visible after loan documents are already moving toward execution.
