Fannie Mae Loan Document Updates Belong on the Closing Calendar
Lender Letter 26-06 gives DUS deal teams a September 8, 2026 mandatory-use date that should be tracked at file opening.
Fannie Mae's July 28, 2026 Lender Letter 26-06 announced multifamily loan document updates that may be used immediately and must be used for most mortgage loans with a confirmed Commitment Date on or after September 8, 2026. Forward conversions occurring on or after that date are also covered, when use is consistent with the Forward Commitment Letter.
For borrower-side closing counsel, the point is practical: document-version control should be part of the opening checklist, not a late-stage scramble. The intake should identify the commitment date, whether the file involves a forward conversion, and whether the deal includes affordability restrictions, tax abatement, public-entity subordination, ground lease, cap escrow, or manufactured housing issues touched by the update.
The letter also highlights newly published or revised forms tied to tax abatement not in place at closing, affordability restriction review, regulatory agreements, subordinate debt, ground lease provisions, subordination and standstill agreements, and interest-rate cap reserve agreements. Each of those items can affect who must review language, what evidence must be collected, and what assumptions belong in the closing record.
