The Fannie Mae Servicing File Starts at Closing

Fannie Mae's servicing-file checklist is a reminder that post-closing delivery should be planned before signature day.

Fannie Mae's Multifamily Servicing File Content Requirements, Form 4800, states that the Lender/Servicer must maintain a separate servicing file, or set of files, for each mortgage loan it services. The file may be maintained in paper or electronic imaged form if applicable record-retention requirements are met.

The checklist reaches well beyond the signed note and security instrument. It identifies origination and commitment documents, underwriting records, loan documents, and servicing records, including items such as borrower organizational documents, good standing certificates, environmental and ASTM materials, ground leases and estoppels, surveys, UCC filings, insurance policies, title policies and endorsements, opinions, management agreements, subordinate loan documents, waivers, escrows, tax receipts, and inspection records.

For borrower-side closing counsel, the practical point is that post-closing delivery should be designed before closing. If the lender will need recorded instruments, filed UCC evidence, final title endorsements, survey originals, opinion copies, insurance evidence, or subordinate financing documents, those items should have an owner and expected delivery date before signatures are released.

A clean closing handoff should separate signed-at-closing items from post-closing evidence items. The checklist should show what has been executed, what must be recorded or filed, what must come back from title or the recorder, and who is responsible for the final package.
