Freddie Mac Final Delivery Needs a Complete Funds Trail

The current Guide links settlement statements, escrow instructions, disbursement records, and wire or check evidence.

Freddie Mac's current Multifamily Seller/Servicer Guide, Chapter 32, requires the Borrower's Final Delivery Package to include specified settlement statements and related documentation. Those materials must comply with the most current version of Freddie Mac's Closing Documentation Guidelines posted with the Loan Documents.

The required package includes the Borrower's final executed settlement statement and, for a property acquisition, any final executed seller-side settlement statements. It also includes copies of closing statements and escrow instruction letters that the Freddie Mac Seller or its counsel provided to the parties performing the transaction's funding and escrow functions.

Chapter 32 also requires a receipts-and-disbursements ledger for the mortgage and, when applicable, the acquisition of the property or ownership interests, or other written evidence from the title company. That record must be accompanied by evidence of all corresponding wires or checks received or sent for the mortgage or acquisition. Delivery of the package is treated as the Seller/Servicer's representation and warranty that it complied with these requirements.

For borrower-side counsel, a practical funds-trail matrix should identify each receipt and disbursement, its purpose, payor, payee, amount, settlement-statement line, escrow instruction, and supporting wire or check. The final review should reconcile that matrix to the executed closing documents and flag unexplained differences before the delivery package is assembled.
