Freddie Mac Forward Commitments Now Have a Five-Day Alert

Bulletin M2026-5 makes specified construction-phase changes a prompt reporting event, with email recipients and a five-Business-Day clock.

Freddie Mac's October 20, 2026 Multifamily Seller/Servicer Guide Bulletin, M2026-5, updates Sections 17A.7 and 19A.7 for Forward Commitments. The Bulletin states that its revisions are effective immediately unless otherwise noted. The new construction-phase reporting rule therefore belongs in active forward-commitment monitoring now, not only in newly opened files.

The first trigger is the Seller's awareness of a material adverse change in the property's rental income, operation, physical condition, or title from what was disclosed in writing to the Seller/Servicer or Freddie Mac. A practical review should compare the newly learned fact with the written underwriting and commitment record, rather than relying on whether the project team informally considers the issue manageable.

The second trigger applies when the Borrower or any Borrower Principal tells the Seller that it is unable or unwilling to satisfy a Condition to Conversion or to consummate the loan under the Forward Commitment by its Maturity Date. In either trigger category, the Seller must email its Freddie Mac Production relationship manager and copy Forward_Commitment_Monitoring@freddiemac.com within five Business Days. The Bulletin also revises Form 5150, Forward Commitment Monitoring Report, to add an Original Contingency field.

For borrower-side counsel, one monitoring log should record the date an issue was identified, the prior written disclosure baseline, the reporting trigger, supporting documents, the lender contact, the five-Business-Day deadline, and any Form 5150 consequence. Construction, title, property-management, and borrower-principal updates should reach the lender promptly enough for the Seller to evaluate and meet its reporting duty. This note is informational only and is not legal advice for any specific transaction.
