HUD Multifamily Form Updates Make Firm Commitment Dates a Closing Item

HUD's current forms page ties multiple multifamily closing documents to firm commitments issued on or after April 1, 2026.

HUD's public forms page now lists multiple multifamily closing documents for use in transactions where HUD issued a firm commitment on or after April 1, 2026. That group includes forms and riders for building code verification, architectural and engineering fee certification, LIHTC-related security instrument language, borrower organizational provisions, restrictive covenants, survey affidavits, and third-party obligee certification.

For FHA/HUD multifamily closing counsel, the practical point is simple: the firm commitment date should be captured at file opening and treated as a document-version control item. A closing team should not assume that a prior HUD closing package, prior borrower form set, or recycled rider is still the right version for the current transaction.

The issue is not only clerical. When a form touches building code evidence, borrower organizational provisions, survey status, restrictive covenants, or third-party rights, the wrong version can create avoidable comments from HUD, lender counsel, title, survey, or borrower-side reviewers late in the process.
