HUD Post-Endorsement Dockets Need a Final Change Check

HUD's post-closing certification makes schedules, exhibits, and post-release edits part of the final document-control review.

HUD's Electronic Closing Resources identify the Electronic Closing Protocols, effective March 4, 2024, as the standard operating protocols for electronic FHA multifamily and healthcare closings. HUD also provides a Certification of No Changes for Post-Endorsement Docket Submissions for the complete electronic set of final, fully executed documents delivered after the FHA note is endorsed.

The certification states that, to the signer's knowledge, each transmitted document reflects the version finally approved and relied upon by HUD when it released the FHA note. That representation expressly includes the schedules, attachments, and other exhibits incorporated into or included with the executed documents as a condition to closing and endorsement.

The form treats any change made after release of the FHA note as material and requires it to be disclosed to and approved by HUD. Stamps and similar markings added by a governmental land-records office for recording purposes are excluded from that rule. The certification must be signed by the FHA lender and by any party submitting the post-endorsement docket on the lender's behalf; if a revision prevents delivery of the certification, the form directs the parties to contact the assigned closing coordinator.

For borrower-side counsel, the post-closing checklist should preserve a locked copy of the HUD-approved execution set, compare every returned, recorded, and trailing document against that set, and identify any changed schedule, exhibit, signature page, or substantive text before docket submission.
